- PRIORITY TERMS.
These VeriFLY Priority Service terms and conditions (“Priority Terms”) are Additional Terms to, and incorporated into, the End User License Agreement (“Agreement”) between you and the Daon entity listed in the Agreement (“Company”, “we”, or “us” or “our”). Any capitalized terms used but not defined herein shall have the meaning given to them in the Agreement. By purchasing the VeriFLY Priority Service (defined below) or using a part of the Application or Content and Services where the Priority Service is sold or offered for sale, you agree to these Priority Terms, the Agreement, and any other applicable Additional Terms.
- PRIORITY SERVICE.
We may from time-to-time make available on the Application Priority Content and Services which are accessible to you by paying a fee, under which VeriFLY or its designee will review any required travel documents you submit (“Travel Documents”) within the time frame indicated in Additional Terms at the time of purchase (“Priority Service”), rather than being reviewed on a first-come, first-serve basis based on the time of submission. The Priority Service shall be considered “Content and Services” as defined in the Agreement.
Purchase of the Priority Service provides you with access to expedited review of travel documents in association with each particular flight or other leg or portion of a trip which you are scheduled to take (“Flight”), and must be purchased separately for each Flight, including separate Flights associated with a single “trip” (by way of example, a standard round trip includes two Flights, and the Priority Service must be purchased for each Flight, as desired by you).
You acknowledge and agree that, subject to the disclaimer of warranties and other terms and conditions in the Agreement, Company does not guarantee that your use of the Priority Service will result in any particular result or guarantee acceptance of your Travel Documents pursuant to the applicable Guidelines (defined below), and that the acceptance of your Travel Documents depends on a number of factors, including the time between submission of your Travel Documents and your Flight, quality of documents submitted, and whether they meet the applicable criteria associated with your Flight. If you have not submitted the proper Travel Documents or if your Travel Documents are otherwise rejected for any reason with respect to a particular Flight, including based on Company’s or the applicable third party’s then-current guidelines or any Additional Terms (“Guidelines”), you are entitled to re-submit Travel Documents for such Flight at no additional cost for that particular Flight. For the sake of clarity, you must purchase the Priority Service for each Flight, including where multiple Flights are part of the same trip.
- ORDER ACCEPTANCE, BILLING, AND REFUNDS.
You are responsible for payment of your order for the Priority Service with respect to each Flight for which you make a purchase by means of a payment option made available through the Application at the time of ordering. We use third-party providers and may accept various third-party services to process payments. You understand and agree that, when you register a payment card on the Service, Company or its third-party service providers may verify that the payment card you registered is valid. You authorize Company or its third-party service providers to process the order amount to the payment card you selected when you submitted your order. We reserve the right to refuse or cancel an order for any reason, including inaccuracies, errors in product or pricing information, or problems identified with your payment method (including suspected fraud). If your credit or debit card has already been charged for the purchase and your order is canceled for the reasons discussed in these Priority Terms, we will promptly issue a credit to your credit or debit card account in the amount of the incorrect price.
You agree that your order is an offer to buy and pay for, under these Priority Terms, the Priority Service listed in your order, as well as all applicable taxes. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept any orders in our sole discretion. Acceptance of your order by Company will not take place unless and until you have received a confirmation within the Application and/or via email.
If the Priority Service you purchased from Company is not as described or is unable to be performed by Company or its designee, generally or within the indicated time frame, for any reason whatsoever, as permitted by applicable law, your sole remedy is to receive a refund or credit to your account (as determined by Company in its sole discretion) for the purchase price. However, while you are entitled to re-submit your Travel Documents in association with a particular Flight as described above if they are rejected, please note that you are not entitled to a refund if your Travel Documents are rejected for non-compliance with the applicable Guidelines (except where such rejection is due to Company’s action or inaction).
- PROMOTIONAL CODES
We may from time-to-time offer promotional codes for discounts. Promotional codes are limited in nature and may expire or be discontinued with or without notice. Promotional codes are void where prohibited by law. Promotional codes may not be copied, sold, or otherwise transferred. They are not redeemable for cash and are subject to cancellation or change at any time for any reason without notice. We reserve the right in our discretion to impose conditions on the offering of any promotional code.
